5. Marketplace Rules
5.1 Buyer Responsibilities

All prices are displayed in Pakistani Rupees (PKR) unless otherwise stated. Prices are subject to change without notice. We reserve the right to correct pricing errors and may cancel orders placed at incorrect prices.

8. Shipping and Delivery
Estimated delivery times are provided for reference only and are not guaranteed. We are not responsible for delays caused by carriers, customs, or events beyond our control.
Risk of loss and title for products pass to you upon delivery to the carrier. You are responsible for filing claims with carriers for lost or damaged shipments.
9. Returns and Refunds
We offer a 30-day return policy for most products. To be eligible for a return:
- Items must be unused and in original condition
- Original packaging must be included
- Return request must be initiated within 30 days of delivery
- Proof of purchase must be provided
Certain items are not eligible for return, including:
- Perishable goods
- Custom or personalized items
- Digital products or downloadable software
- Items marked as final sale
Refunds will be processed within 5-7 business days after we receive and inspect the returned item. Refunds will be issued to the original payment method.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Services will be uninterrupted, timely, secure, or error-free. We do not warrant the accuracy, completeness, or reliability of any content, information, or materials available through the Services.
12. Limitation of Liability
LIABILITY LIMITATIONS:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMPERIAL FIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICES.
Our total liability to you for any claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us in the twelve (12) months prior to the event giving rise to the liability, or PKR1000, whichever is greater.
13. Indemnification
You agree to indemnify, defend, and hold harmless Imperial Fit and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another party.
14. Dispute Resolution
14.1 Informal Resolution
Before filing a formal dispute, you agree to contact us first and attempt to resolve the issue informally by sending a written notice to our support team.
14.2 Arbitration
Any dispute arising out of or relating to these Terms or the Services shall be resolved rather than in court, except that you may assert claims in small claims court if your claims qualify.
14.3 Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between you and us individually. You agree to waive any right to have any dispute brought, heard, or arbitrated as a class action or collective action.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Pakistan and the State of Sindh, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Sindh, Pakistan.
16. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will post the updated Terms on our website and update the "Last updated" date. We may also notify you via email or through the Services. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
18. Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Services, constitute the entire agreement between you and Imperial Fit concerning the Services and supersede all prior or contemporaneous communications and proposals.
